INFORMATION ON COOKIES

What are cookies

Cookies are short text strings that websites visited by the user send to his display device, usually to the browser, where they are stored and then retransmitted to the same websites when the same user visits it subsequently. While browsing through a website a user may also receive on his device cookies from other websites or web servers (so-called “third-party cookies”), which may contain some elements, such as, for example, images, maps, sounds, or specific links to pages of other domains, present on the website that the user is visiting.

Cookies, which are usually stored on users’ browsers in large number, including persistent cookies, are used for various purposes such as the execution of digital authentications, session monitoring, storage of information on specific configurations concerning the users who access the server, etc.

Types of cookies

Cookies can be divided into two macro categories: “technical” cookies and “profiling” cookies.

Technical cookies

Technical cookies are cookies used exclusively to “transmit a communication on an electronic communication network, or to the extent strictly required by a company service provider responsible for delivering information explicitly requested by the subscriber or user in order to provide that service” (see art. 122, paragraph 1 of the Data Protection Code).

They are not used for other purposes and are normally installed directly by the owner or operator of the website. They can be subdivided into browsing or session cookies, which guarantee normal browsing and use of the website (allowing, for example, to make a purchase or get authenticated to access reserved areas).

“Analytics cookies” are similar to technical cookies when used directly by the website operator to gather information in an aggregated form on the number of users and on how they visit the website. Functionality cookies allow the user to browse according to a set of selected criteria (e.g. language, products selected for purchase) in order to improve the service provided to him.

There is another type of cookies the so-called “Flash Cookies” (Local Shared Objects), which are used in Adobe Flash Player to provide some contents such as video clips or animations, in order to remember settings and preferences. Flash cookies are stored on the device, but they are managed by a different interface with respect to that supplied by the browser used.

Prior consent of users is not required for installing these cookies, whereas it is mandatory to publish the policy pursuant to art. 13 of the Data Protection Code, which the website operator, if using exclusively these devices, may provide according to the methods it deems most suitable.

Profiling cookies

Profiling cookies are designed to create user profiles and are used in order to forward advertising messages in line with the preferences expressed by the user during his browsing on the Internet. Due to the particular invasive nature that those devices may have in relation to user privacy, European and Italian regulations state that the user must be adequately informed on the use of profiling cookies and provide his valid consent.

Profiling cookies are addressed by art. 122 of the Data Protection Code, which prescribes that “the storage of information on the terminal device of a contractual party or user or access to information already stored on the device is permitted solely on the condition that the contractual party or user has expressed his or her consent after being informed by means of the simplified methods as per article 13, paragraph 3” (art. 122, paragraph 1, of Data Protection Code).

  • MATOMO ANALYTICS Matomo uses cookies to identify and keep track of visitors and their use of the website. All the data is gathered in an anonymous and aggregated form. DISCLAIMER

The exact nature of certain cookies (which, under special circumstances, could be considered “profiling cookies”) could be reconsidered in the future based on the evolution of interpretation of the directives of the Data Protection Authority. In that case, this privacy policy shall be appropriately updated and any additional compliance requirements shall be implemented.

LIFETIME OF COOKIES

Cookies have a lifetime that depends on their expiration date, or on a specific action such as browser closing, preset at the time of installation. Cookies can be:

  • temporary or session cookies – used to store temporary information; they make it possible to interconnect the actions performed during a specific session and are removed from the computer on closing the browser;

  • persistent cookies – used to store information, such as, for example, username and access password, in order to avoid the user having to re-enter his/her data on each fresh visit to a specific website. They remain stored on the computer even after the browser is closed.

MANAGEMENT OF COOKIES – HOW TO DISABLE THEM

Cookies are enabled by default in most browsers. The user can decide whether to accept or not cookies using settings of his/her browser.

If consent has already been provided but users intend to change the cookie authorizations, they must be deleted from the browser as described below. Otherwise cookies already installed will not be removed. In particular, note that it is not possible in any way to check third-party cookies.

Therefore, if consent was already granted before, they must be deleted from the browser (dedicated section) or an opt-out request has to be sent directly to third parties.
